When Does Alimony Stop?

Will I have to pay alimony forever?

Some people are ordered to pay alimony or spousal support. They often ask, “When will my alimony stop?” If either the person paying or receiving alimony dies, alimony stops. If the person receiving alimony remarries, alimony will stop under most circumstances. Alimony can also stop if the person who pays can show a substantial change of circumstances has occurred, such as becoming disabled, unemployed, or retiring.

Also, if the supported spouse resides with another person in a romantic relationship for a period of ninety or more consecutive days, alimony may stop. The court may determine that a continued cohabitation exists if there is evidence that the supported spouse resides with another person in a romantic relationship for periods of less than ninety days and the two periodically separate in order to circumvent the ninety-day requirement.
